Lead Renovation, Repair and Painting Rule
Since its enactment on April 22, 2010, The EPA's Lead-Safe Certification rule has been amended several times and has generated a lot of questions, so we've decided to put together a page of information to help navigate the regulation. The EPA suspension of fines for non-compliance of the lead RRP rule made on 6/18/10
DOES NOT APPLY IN MASSACHUSETTS!
Since Massachusetts took over enforcement of the rule on July 9th, fines have been in place and anyone who is not certified is not in compliance and is subject to fines by the Massachusetts Division of Occupational Safety.
The orginal EPA rule allowed certified remodelers to leave the jobsite or periods of time if they had trained other employees in lead-safe practices. The Massachusetts rule does not allow for this. Under the Massachusetts' law, a certified renovator
MUST
be on site for the duration of any job where lead paint is involved.

Massachusetts Department of Occupational Safety
: for all contractors based in Massachusetts, the Mass DOS has taken over enforcement of the EPA rule as of 7/9/10. If you have already been trained, you do not need additional training. If you already have a firm certification from the EPA (issued prior to 7/9/10), you need to complete a waiver form and submit it to the State (no fee is involved) in order to have your firm certification recognized in Massachusetts. Important Documents:
Massachusetts Firm Certification Application
: this is the new application you must complete and submit to the State to apply for firm certification if you have not already applied through the EPA prior to 7/9/10.
Massachusetts Firm Certification Waiver Form
: this waiver form must be completed and filed with Massachusetts if you received or applied for your firm certification from the EPA prior to 7/9/10 in order for you to be recognized in the State. There is no fee associated with this.

: all contractors must present this brochure to homeowners where renovation work is being done on a house that was built pre-1978 - PRIOR to the work starting.
